- AI answers can be wrong. You decide what to say.
- Refunds: unused paid credit is refundable within 30 days of the top-up.
1. About these terms
These terms are an agreement between you and Voidraft LLC, a Delaware limited liability company with the mailing address 2108 N St #18080, Sacramento, CA 95816 (“we”, “us”). They cover your use of Fermo: the website at fermo.app and the web app at app.fermo.app.
When you create an account or use Fermo, you accept these terms and our Privacy Policy. If you do not accept them, do not use Fermo.
2. Who can use Fermo
You must be 18 or older and able to make a binding contract.
3. Your account
- You sign in with a code that Fermo sends to your email, with Google, or with a passkey that you add in Settings.
- Keep your email account and your passkeys secure. Anyone who controls them can sign in to Fermo as you.
- An account is for one person. Do not share it.
- One account can run one live session at a time.
- If you think that someone else used your account, tell us at [email protected].
4. What Fermo is, and what it is not
- Fermo listens to a conversation that you choose, writes it down and suggests talking points. It uses what it hears, your notes, the files that you add and the part of your screen that you share.
- Fermo is in a limited beta. Features can change, and faults can occur. We can add, change or remove features.
- AI answers can be wrong, incomplete or out of date. You decide what to say and what to do. Check the facts that matter.
- Fermo is not legal, medical or financial advice.
- We do not promise a result, such as passing an interview or getting a job.
5. Credit and payment
- Setup, the sound check, Sources and History are free. Live sessions use prepaid credit.
- Live sessions are charged by the minute from your credit, at a rate for each mode: interview, meeting or practice. New accounts get 20 free minutes. We show the rates on the pricing section and at checkout before you pay, and your balance on your Credit page. We warn you when your credit runs low. If it runs out during a session, Fermo finishes the current answer and then pauses the session.
- You add credit with a one-time payment of at least $10. Nothing renews or charges you on its own. Credit does not expire.
- Payments go through Stripe’s Managed Payments service. Sold through Link, LLC (“Link”), a Stripe company, is the merchant of record. Voidraft LLC is the seller of the credit. Link charges you, adds sales tax where it applies, and sends your receipt. Link’s own terms (the Sold through Link Terms) also apply to the purchase. Your card statement shows LINK.COM* FERMO.
- Prices are shown before tax. Link calculates the tax at checkout and adds it where it applies.
- We may not be able to sell credit in every country.
- A rate change applies only to minutes that you use after it takes effect. We announce it on the pricing section 14 days before. If you do not accept a new rate, we refund your unused paid credit.
- Credit belongs to your account. You cannot sell it or transfer it.
6. Refunds
- You can get a refund of your unused paid credit if you ask within 30 days of the top-up. Free minutes are not refunded. Email [email protected] from the email address of your account.
- If a fault on our side interrupts a session, tell us. We add the lost minutes back to your credit.
- Link can also refund a purchase in some cases under its own rules, within 60 days of the purchase.
- A refund removes the refunded amount from your credit. If you dispute a charge with your bank, we can pause your credit until the dispute closes.
- If you are a consumer in the EU or the UK, Link’s terms let you cancel your purchase within 14 days of the day you get access to your credit. To do this, ask Link support for a refund and give “cooling off period” as the reason.
- Nothing in these terms takes away refund rights that the law of your country gives you.
7. Consent and recording: your responsibility
Fermo is made to be used in the open. It does not listen until you start a session and confirm that the people present agree. It does not hide from screen sharing.
Before and during each session, you are responsible for:
- telling everyone in the conversation that you use Fermo, and what it does. Fermo gives you a notice to read out or to send;
- getting the agreement that the law requires where you and the other people are. In some places, everyone in the conversation must agree;
- asking people who join later;
- stopping Fermo when someone says no or changes their mind.
When you confirm agreement in the consent step, you tell us that you did these things. Fermo cannot check this.
8. The rules where you use Fermo
Employers, schools, interview and testing platforms, and meeting services can have their own rules about AI tools, transcription or recording. You are responsible for knowing and following the rules of each interview, employer, school or platform where you use Fermo. Fermo does not check these rules. If you are not sure, ask the organizer before you start.
9. Fair use
Do not:
- use Fermo to break the law or to harm the rights of other people;
- attack, overload or disrupt Fermo or its providers, or try to get around its limits, its security or its payments;
- scrape Fermo, use bots to access it, or try to copy its software, its prompts or other parts that are not public, except as the law allows;
- sell, rent or share access to Fermo, or share your account or your credit;
- upload malware, or content that you do not have the right to use;
- use Fermo for anything that Google’s Gemma Prohibited Use Policy forbids. Fermo searches your files with Google’s EmbeddingGemma model.
10. Your content
- Your content is what you give Fermo and what Fermo makes for you: audio, transcripts, notes, files, sources, screen content and answers. You keep your rights in it.
- You let us process your content only to run Fermo for you, including through the providers named in our Privacy Policy.
- We do not use your content to train AI models.
- You confirm that you have the right to use the content that you give Fermo.
- Fermo saves your content on your device, and in your Google Drive if you turn on backup. It does not save it on our servers. We cannot restore it if it is lost. Use Export or Google Drive backup to keep a copy.
11. Our rights
- Fermo, its software, its design, its prompts and its name belong to Voidraft LLC. While you follow these terms, we give you a personal right to use Fermo. You cannot transfer this right. We can end it as section 13 says.
- If you send us ideas or feedback, we can use them freely, with no duty to you.
- Open-source parts of Fermo come with their own licenses.
12. Other services
Fermo works with other services, such as Google, Stripe and Link, and speech and AI providers. When you use Google sign-in or Google Drive with Fermo, Google’s terms also apply. When you add files, Fermo searches them with Google’s EmbeddingGemma model through Cloudflare. Google’s Gemma Terms of Use govern that model. We are not responsible for services that we do not control.
13. Ending your use
- You can stop using Fermo at any time. To delete your account, use Delete account in Settings, or email us.
- We can suspend or end your access if you break these terms, if your use puts other people at risk, or if the law requires it. When it is reasonable, we tell you first.
- If we end your access because you broke these terms, you get no refund.
- If we stop offering Fermo, or end your access for another reason, we refund your unused paid credit.
- When your account ends, we delete the data on our servers as our Privacy Policy says. If you use Delete account in Settings, Fermo also clears its data on that device. The data on your other devices and in your Google Drive stays until you delete it.
- Sections 10, 11 and 14 to 19 continue after your account ends.
14. No warranties
We provide Fermo “as is” and “as available”. As far as the law allows, we give no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that Fermo will always work, that it will have no errors, or that its answers will be correct.
15. Limits on our liability
As far as the law allows:
- We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost opportunities, including the result of an interview, exam or meeting.
- Our total liability for all claims about Fermo is limited to the amount that you paid us.
These limits do not apply where the law does not allow them.
16. Claims caused by your use
You agree to cover our reasonable costs and losses from claims by other people that your breach of section 7, 8 or 9 causes, for example when you used Fermo without the agreement that the law requires. This does not apply where the law does not allow it.
17. Law and disputes
- The laws of the State of California, USA, govern these terms, without regard to conflict-of-law rules.
- If you have a problem, write to us first. We try to solve it within 30 days.
- If we cannot solve it, the state and federal courts in Santa Clara County, California decide the dispute. Either of us can use a small-claims court instead. These terms do not require arbitration.
- If you are a consumer in a country whose law gives you more protection, such as a country in the EU or the UK, you keep that protection and you can go to your local courts.
18. Changes to these terms
We can change these terms. We post the new version on this page with a new “Last updated” date. If a change is important, we email you 14 days before it takes effect. If you keep using Fermo after that, you accept the new terms. If you do not accept them, stop using Fermo and we refund your unused paid credit.
19. General
- These terms and our Privacy Policy are the whole agreement between you and us about Fermo.
- If a court finds one part invalid, the rest stays in force.
- If we do not enforce a right at once, we do not give it up.
- You cannot transfer these terms to another person. We can transfer them to a company that takes over Fermo, and we will tell you.
- We are not responsible for delays from events that we cannot control, such as an outage at a provider.
- We send notices to the email address of your account.
